Relates to the appropriation to the Public Schools Educational Support Program's Division of the Idaho Digital Learning Academy for fiscal year 2027.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE BILL NO. 1452 BY FINANCE COMMITTEE AN ACT1 RELATING TO THE APPROPRIATION TO THE PUBLIC SCHOOLS EDUCATIONAL SUPPORT PRO-2 GRAM'S DIVISION OF THE IDAHO DIGITAL LEARNING ACADEMY; AMENDING SECTION3 22 OF SENATE BILL NO. 1362, IF ENACTED BY THE SECOND REGULAR SESSION OF4 THE SIXTY-EIGHTH IDAHO LEGISLATURE TO REVISE PROVISIONS REGARDING THE5 IDAHO DIGITAL LEARNING ACADEMY; AND DECLARING AN EMERGENCY AND PROVID-6 ING AN EFFECTIVE DATE.7

Be It Enacted by the Legislature of the State of Idaho:8

SECTION 1. That Section 22 of House Bill No. 1362, if enacted by the9 Second Regular Session of the Sixty-eighth Idaho Legislature, be, and the10 same is hereby amended to read as follows:11

SECTION 22. IDAHO DIGITAL LEARNING ACADEMY. The Idaho Digital12 Learning Academy (IDLA), created pursuant to Chapter 55, Title 33,13 Idaho Code, shall utilize state-appropriated funds for the period14 July 1, 2026, through June 30, 2027, to achieve the following:15 (1) Tuition charged by IDLA to Idaho school districts and ch-16 arter schools shall not exceed $40.00 per enrollment.17 (2) (1) Provide remedial coursework for students failing to18 achieve proficiency in one or more areas of Idaho's standards-based19 tests.20 (3) (2) Pursuant to State Board of Education rule, IDAPA21 08.02.03, provide advanced opportunities, including access to dual22 credit courses, for students.23 The preceding list shall not be construed as excluding other24 instruction and training that may be provided by the IDLA.25

SECTION 2. An emergency existing therefor, which emergency is hereby26 declared to exist, this act shall be in full force and effect on and after27 July 1, 2026.28
