RS33864 / H0975 This bill directs that no transfer from the Budget Stabilization Fund will occur if the fund balance exceeds 15% of General Fund revenues in FY 2026 as required by Section 57-814, Idaho Code.

The current balance in the Budget Stabilization Fund is $880.2 million. This balance will remain at that level in FY 2027 even if the balance is more than 15% of FY 2026 General Fund revenue. The does not preclude a transfer from the Budget Stabilization Fund if FY 2026 General Fund revenues are not sufficient to balance the budget in accordance with Section 57-814A, Idaho Code.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 975 BY APPROPRIATIONS COMMITTEE AN ACT1 RELATING TO APPROPRIATIONS; LIMITING CASH TRANSFERS FROM THE BUDGET STABI-2 LIZATION FUND FOR FISCAL YEARS 2026 AND 2027; AND DECLARING AN EMERGENCY3 AND PROVIDING AN EFFECTIVE DATE.4
Be It Enacted by the Legislature of the State of Idaho:5
SECTION 1. CASH TRANSFERS FROM THE BUDGET STABILIZATION FUND IN FIS-6 CAL YEARS 2026 AND 2027. Notwithstanding the provisions of Section 57-814,7 Idaho Code, which limits the allowable balance in the Budget Stabilization8 Fund to 15% of total General Fund receipts for the fiscal year just ending and9 requires the Office of the State Controller to transfer excess moneys in the10 Budget Stabilization Fund back to the General Fund, and notwithstanding any11 other provision of law to the contrary, the Office of the State Controller12 shall not transfer funds from the Budget Stabilization Fund to the General13 Fund for the period June 1, 2026, through June 30, 2027.14
SECTION 2. An emergency existing therefor, which emergency is hereby15 declared to exist, this act shall be in full force and effect on and after16 June 1, 2026.17
