Amends existing law to provide for the use of development impact fees for public school facilities.
This bill adds public schools to the list of public facilities and school districts to the list of government entities allowed to use the statutory development impact fee mechanism to fund capital improvements attributable to new growth and development. The Local Land Use Planning Act identifies and specifically names school districts as governmental entities to be notified or considered in mitigating development impacts in at least four sections. To achieve consistency and uniformity in addressing and mitigating the effects of new growth and development, adding school districts to the development impact fee code accomplishes the intent contemplated in the local land use planning act and places statutory limits on the amount of school impact mitigation a local jurisdiction can exact from new development.

he purpose of this legislation is to provide public school districts with the authority to collect development impact fees. Development impact fees collected by public school districts would be limited in their use to capital improvements. By giving public school districts this ability, the ability for new growth to pay for itself is increased and the need for public school districts to use bonding authority to raise funds for capital improvements may be reduced. Consequentially, the property tax burden on property taxpayers within the affected school district may decrease as a result of decreased need for public school districts to utilize their bonding authority.

Amends existing law to provide for the refund of wrongfully charged development impact fees.
Amends existing law to revise provisions regarding a development impact fee advisory committee and to provide for a development impact fee advisory committee for intergovernmental agreements between governmental entities and certain districts.
The purpose of this legislation is to provide flexibility in the makeup of an impact fee advisory committee to ensure it is representative of the area it serves.
