LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 127 BY STATE AFFAIRS COMMITTEE A CONCURRENT RESOLUTION1 STATING FINDINGS OF THE LEGISLATURE AND URGING THE CITIZENS OF IDAHO TO RE-2 JECT ANY EFFORT TO BRING THE IDAHO MEDICAL CANNABIS ACT TO THE BALLOT.3 Be It Resolved by the Legislature of the State of Idaho:4 WHEREAS, the legalization of marijuana in other states has led to in-5 creased cartel activity, development of black market marijuana production,6 human trafficking, and increased crime rates, including violent crime and7 impaired driving; and8 WHEREAS, the legalization of marijuana in other states has led to in-9 creased rates of serious health issues, including psychosis, anxiety, de-10 pression, suicidal ideation, marijuana-linked vomiting or cannabinoid hy-11 peremesis syndrome, cardiac issues, strokes, addiction, diabetes, and harm12 to children in the womb; and13 WHEREAS, the legalization of marijuana in other states has led to ille-14 gal grow sites on federal and state lands that have led to deforestation, di-15 version of water, poisoning of streams, death of wildlife, threats of vio-16 lence from those protecting illegal marijuana grows, and human trafficking;17 and18 WHEREAS, the legalization of marijuana in other states has led to safety19 concerns on job sites and has negatively impacted the supply of drug-free la-20 bor; and21 WHEREAS, the Idaho Medical Cannabis Act may be on the ballot in Idaho as22 an initiated state statute on November 3, 2026; and23 WHEREAS, the Idaho Medical Cannabis Act could ultimately allow 12 mar-24 ijuana production facilities and 36 dispensaries to operate in the State of25 Idaho and would allow online ordering and home delivery of marijuana; and26 WHEREAS, the Idaho Medical Cannabis Act would require multiple state27 agencies and their employees, including the Department of Health and Welfare28 and the State Board of Pharmacy, to create and administer a statewide program29 that involves marijuana manufacturing, processing, transportation, and30 retail sales, including online sales; and31 WHEREAS, the Idaho Medical Cannabis Act would increase the administra-32 tive budget of the Department of Health and Welfare by an estimated $1.1 mil-33 lion annually and require $2.9 million of startup costs at a time when the34 state is facing substantial budget constraints; and35 WHEREAS, the Idaho Medical Cannabis Act does not require a medical re-36 ferral or a prescription to obtain marijuana; and37 WHEREAS, under the Idaho Medical Cannabis Act, the 18 medical condi-38 tions that qualify one to obtain a medical cannabis card, including insom-39 nia, anxiety, and acute pain, are so broad that almost anyone could qualify;40 and41

2 WHEREAS, the Idaho Medical Cannabis Act lacks safeguards to such an ex-1 tent that it would effectively legalize widespread recreational use of mari-2 juana; and3 WHEREAS, the legalization of marijuana would have devastating impacts4 on Idaho children and their families.5 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses-6 sion of the Sixty-eighth Idaho Legislature, the Senate and the House of Rep-7 resentatives concurring therein, that the Legislature urges the citizens of8 Idaho to reject any effort to bring the Idaho Medical Cannabis Act to the bal-9 lot.10 BE IT FURTHER RESOLVED that the Secretary of the Senate be, and she is11 hereby authorized and directed to forward a copy of this Resolution to the12 Governor of the State of Idaho, the Attorney General, and the congressional13 delegation representing the State of Idaho in the Congress of the United14 States.15
