STATEMENT OF PURPOSE

RS33843 / S1447 This bill provides a trailer appropriation and two onetime cash transfers to the Public School Support Program's Division of Student Support as a result of S1288. S1288 established the Idaho High Needs Student Fund to help address the extraordinary costs associated with students with disabilities who require a level of care that exceeds typical special education expenditures. The fund is subject to appropriation and supports reimbursement for high-cost special education services that are not fully covered through existing federal funding streams.

This legislation provides a onetime appropriation of $5,000,000 from the Idaho High Needs Student Fund to the Public School Support Program’s Division of Student Support for distributions to school districts and public charter schools in accordance with S1288. The bill also includes corresponding onetime cash transfers totalling $5,000,000 to the Idaho High Needs Student Fund, consisting of $4,000,000 from the Driver Training Account and $1,000,000 from interest generated in the Idaho Career Ready Students Program Fund. These cash transfers provide the necessary fund balance to support the appropriation.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE BILL NO. 1447 BY FINANCE COMMITTEE AN ACT1 RELATING TO THE APPROPRIATION TO THE PUBLIC SCHOOLS EDUCATIONAL SUPPORT2 PROGRAM'S DIVISION OF STUDENT SUPPORT; APPROPRIATING ADDITIONAL MONEYS3 TO THE PUBLIC SCHOOLS EDUCATIONAL SUPPORT PROGRAM'S DIVISION OF STU-4 DENT SUPPORT FOR FISCAL YEAR 2027; CLARIFYING THE ORIGINAL FUND SOURCE5 FOR EXPENDITURES FOR THE PUBLIC SCHOOLS EDUCATIONAL SUPPORT PROGRAM'S6 DIVISION OF STUDENT SUPPORT; TRANSFERRING MONEYS FROM THE IDAHO CAREER7 READY STUDENTS PROGRAM FUND TO THE IDAHO HIGH NEEDS STUDENT FUND; TRANS-8 FERRING MONEYS FROM THE DRIVER TRAINING ACCOUNT TO THE IDAHO HIGH NEEDS9 STUDENT FUND; PROVIDING FOR CONDITIONS, LIMITATIONS, AND RESTRICTIONS;10 AND DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.11

Be It Enacted by the Legislature of the State of Idaho:12

SECTION 1. In addition to any other appropriation provided by law,13 there is hereby appropriated to the Public Schools Educational Support14 Program's Division of Student Support $5,000,000 from the Idaho High Needs15 Student Fund for the period July 1, 2026, through June 30, 2027.16

SECTION 2. Of the additional amounts appropriated in Section 1 of this17 act for the Public Schools Educational Support Program's Division of Student18 Support, $5,000,000 shall be considered expended from the Idaho High Needs19 Student Fund for the period July 1, 2026, through June 30, 2027.20

SECTION 3. CASH TRANSFER FROM THE IDAHO CAREER READY STUDENTS PROGRAM21 FUND TO THE IDAHO HIGH NEEDS STUDENT FUND. There is hereby appropriated and22 the Office of the State Controller shall transfer $1,000,000 from the Idaho23 Career Ready Students Program Fund to the Idaho High Needs Student Fund as24 soon as practicable for the period July 1, 2026, through June 30, 2027.25

SECTION 4. CASH TRANSFER FROM THE DRIVER TRAINING ACCOUNT TO THE IDAHO26 HIGH NEEDS STUDENT FUND. There is hereby appropriated and the Office of the27 State Controller shall transfer $4,000,000 from the Driver Training Account28 to the Idaho High Needs Student Fund as soon as practicable for the period29 July 1, 2026, through June 30, 2027.30

SECTION 5. CONDITIONS, LIMITATIONS, AND RESTRICTIONS. Appropriations31 made pursuant to this act are subject to the conditions, limitations, and re-32 strictions specified in this act.33

SECTION 6. An emergency existing therefor, which emergency is hereby34 declared to exist, this act shall be in full force and effect on and after35 July 1, 2026.36
