RS33655 / S1414 The current penalty for the crime of rape in Idaho is a minimum of one year to a maximum of life. This legislation increases the minimum penalty from one year to five years and maintains the maximum penalty of life in prison. This brings the minimum penalty for rape in Idaho more in line with other states for this serious felony.

It is difficult to predict the number of rape cases that may occur and result in a conviction or plea of guilty. This legislation may have a fiscal impact on the Department of Corrections because a rapist will be required to remain in prison for a longer minimum period of time which in turn may have a deterrent effect and reduce the number of rapes committed.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE BILL NO. 1414 BY JUDICIARY AND RULES COMMITTEE AN ACT1 RELATING TO RAPE; AMENDING SECTION 18-6104, IDAHO CODE, TO REVISE A PROVI-2 SION REGARDING THE PUNISHMENT FOR RAPE AND TO MAKE TECHNICAL CORREC-3 TIONS; AND DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE.4
Be It Enacted by the Legislature of the State of Idaho:5
SECTION 1. That Section 18-6104, Idaho Code, be, and the same is hereby6 amended to read as follows:7 18-6104. PUNISHMENT FOR RAPE. Rape is punishable by imprisonment in8 the state prison not no less than one (1) year five (5) years, and the im-9 prisonment may be extended to life in the discretion of the District Judge10 district judge, who shall pass sentence.11
SECTION 2. An emergency existing therefor, which emergency is hereby12 declared to exist, this act shall be in full force and effect on and after13 July 1, 2026.14
