HOUSE JOINT MEMORIAL NO. 19
BY STATE AFFAIRS COMMITTEE
A JOINT MEMORIAL	1
TO THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE UNITED STATES IN CON-	2
GRESS ASSEMBLED AND TO THE CONGRESSIONAL DELEGATION REPRESENTING THE	3
STATE OF IDAHO IN THE CONGRESS OF THE UNITED STATES.	4
We, your Memorialists, the House of Representatives and the Sen-	5
ate of the State of Idaho assembled in the Second Regular Session of the	6
Sixty-eighth Idaho Legislature, do hereby respectfully represent that:	7
WHEREAS, the Tenth Amendment to the United States Constitution reserves	8
to the states powers not delegated to the federal government, and education	9
is not enumerated as a responsibility of the federal government; and	10
WHEREAS, the U.S. Department of Education's creation in 1980 has led to	11
significant federal overreach in education through burdensome regulations	12
and one-size-fits-all mandates, many left unfunded despite the department's	13
annual budget of $60 billion; and	14
WHEREAS, as the least regulated state in the nation, Idaho would welcome	15
the opportunity to extend its red tape reduction efforts to the field of pub-	16
lic education where it is desperately needed; and	17
WHEREAS, states and local communities possess unique knowledge of their	18
students' educational needs and are best positioned to develop the curricu-	19
lum and policies that reflect their values and priorities; and	20
WHEREAS, President Trump has publicly expressed a desire to eliminate	21
the U.S. Department of Education and rightfully put the states back in charge	22
of education; and	23
WHEREAS, the elimination of the U.S. Department of Education is not only	24
a constitutional necessity, but will also cause taxpayer dollars to be spent	25
more efficiently and lead to better student outcomes.	26
NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular	27
Session of the Sixty-eighth Idaho Legislature, the House of Representatives	28
and the Senate concurring therein, that the Legislature supports federal	29
efforts to eliminate the U.S. Department of Education and urges the United	30
States Congress to fully cooperate with these efforts.	31
BE IT FURTHER RESOLVED that the Chief Clerk of the House of Representa-	32
tives be, and she is hereby authorized and directed to forward a copy of this	33
Memorial to the President of the Senate and the Speaker of the House of Repre-	34
sentatives of Congress and to the congressional delegation representing the	35
State of Idaho in the Congress of the United States.	36
