RS33805 / SR124 This resolution states that all temporary and pending rules of the Idaho Commission on Aging, the Idaho Commission for the Blind and Visually Impaired, the Department of Health and Welfare, and the Division of Occupational and Professional Licenses have been reviewed and approved by the Senate Health and Welfare Committee (Committee), with exceptions. The Committee reviewed and approved the pending rules of the Division of Occupational and Professional Licenses with the exceptions that the following were not approved: IDAPA 24.05.01, Division of Occupational and Professional Licenses, Rules of the Board of Drinking Water and Wastewater Professionals, Docket No. 24-0501-2501, Section 400., only; and IDAPA 24.06.01, Division of Occupational and Professional Licenses, Rules for the Licensure of Occupational Therapists and Occupational Therapy Assistants, Docket No. 24-0601-2501, the entire docket. Additionally, the Committee did not review and therefore did not approve the following pending rules at the request of the Department of Health and Welfare, who expressed intent to allow the rules to expire on sine die: IDAPA 16.06.03, Department of Health and Welfare, Rules for Daycare Licensing, Docket No. 16-0603-2501, the entire docket; and IDAPA 16.06.12, Department of Health and Welfare, Rules for the Idaho Child Care Program, Docket No. 16-0612-2501, the entire docket.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE SENATE SENATE RESOLUTION NO. 124 BY JUDICIARY AND RULES COMMITTEE A SENATE RESOLUTION1 STATING FINDINGS OF THE SENATE AND PROVIDING THAT ALL TEMPORARY AND PEND-2 ING RULES OF THE IDAHO COMMISSION ON AGING, THE IDAHO COMMISSION FOR3 THE BLIND AND VISUALLY IMPAIRED, THE DEPARTMENT OF HEALTH AND WELFARE,4 AND THE DIVISION OF OCCUPATIONAL AND PROFESSIONAL LICENSES HAVE BEEN5 REVIEWED AND APPROVED BY THE SENATE HEALTH AND WELFARE COMMITTEE, WITH6 EXCEPTIONS.7 Be It Resolved by the Senate of the State of Idaho:8 WHEREAS, pursuant to Section 67-5291, Idaho Code, standing committees9 of the Legislature shall review any temporary or pending rule that is ger-10 mane to its committee and has been published in the Idaho Administrative Bul-11 letin; and12 WHEREAS, the Senate Health and Welfare Committee reviewed temporary and13 pending rules adopted by the Idaho Commission on Aging, the Idaho Commission14 for the Blind and Visually Impaired, the Department of Health and Welfare,15 and the Division of Occupational and Professional Licenses; and16 WHEREAS, the Senate Health and Welfare Committee did not review and17 therefore did not approve the following pending rules at the request of the18 Department of Health and Welfare, who expressed intent to allow the rules to19 expire upon sine die:20 (1) IDAPA 16.06.03, Department of Health and Welfare, Rules for Daycare21 Licensing, Docket No. 16-0603-2501, the entire docket, at the request22 of the department; and23 (2) IDAPA 16.06.12, Department of Health and Welfare, Rules for the24 Idaho Child Care Program, Docket No. 16-0612-2501, the entire docket,25 at the request of the department.26 NOW, THEREFORE, BE IT RESOLVED by the members of the Senate, assembled27 in the Second Regular Session of the Sixty-eighth Idaho Legislature, that28 all temporary and pending rules adopted by the Idaho Commission on Aging,29 the Idaho Commission for the Blind and Visually Impaired, the Department of30 Health and Welfare, and the Division of Occupational and Professional Li-31 censes, pursuant to the Administrative Procedure Act and submitted through32 the Office of the Administrative Rules Coordinator to the Legislature for33 review during the 2026 legislative session have been reviewed and approved34 by the Senate Health and Welfare Committee, with the following exceptions35 that were not approved:36 (1) IDAPA 16.06.03, Department of Health and Welfare, Rules for Daycare37 Licensing, Docket No. 16-0603-2501, the entire docket, at the request38 of the department;39 (2) IDAPA 16.06.12, Department of Health and Welfare, Rules for the40 Idaho Child Care Program, Docket No. 16-0612-2501, the entire docket,41 at the request of the department;42
