RS33558 / H0914 This legislation creates a temporary five (5) year moratorium on any additional rule-making and fees promulgation by the Division of Occupational and Professional Licenses. It also requires that the Division of Occupational and Professional Licenses submit to the legislative services office proposed legislation that transfers all division of occupational and professional licenses administrative rule chapters less than eight (8) pages into statute by December 31, 2026.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 914 BY WAYS AND MEANS COMMITTEE AN ACT1 RELATING TO THE DIVISION OF OCCUPATIONAL AND PROFESSIONAL LICENSES; AMEND-2 ING CHAPTER 26, TITLE 67, IDAHO CODE, BY THE ADDITION OF A NEW SECTION3 67-2616, IDAHO CODE, TO PROVIDE FOR A TEMPORARY MORATORIUM ON RULEMAK-4 ING AND FEES; AMENDING CHAPTER 26, TITLE 67, IDAHO CODE, BY THE ADDITION5 OF A NEW SECTION 67-2617, IDAHO CODE, TO PROVIDE FOR THE MIGRATION OF6 CERTAIN ADMINISTRATIVE RULES INTO STATUTE; AND DECLARING AN EMERGENCY7 AND PROVIDING AN EFFECTIVE DATE.8

Be It Enacted by the Legislature of the State of Idaho:9

SECTION 1. That Chapter 26, Title 67, Idaho Code, be, and the same is10 hereby amended by the addition thereto of a NEW SECTION, to be known and des-11 ignated as Section 67-2616, Idaho Code, and to read as follows:12 67-2616. TEMPORARY MORATORIUM ON RULEMAKING AND FEES. (1) Notwith-13 standing any other provision of law to the contrary, for the period July 1,14 2026, through June 30, 2031, the division of occupational and professional15 licenses, including the administrator of such division and the boards and16 commissions within such division, shall not be authorized to promulgate any17 additional administrative rules or to increase any occupational licensing18 fee.19 (2) Notwithstanding the provisions of subsection (1) of this section,20 the division of occupational and professional licenses, including the ad-21 ministrator of such division and the boards and commissions within such di-22 vision, shall be authorized to conduct rulemaking for the purpose of repeal-23 ing existing regulations or removing a regulatory burden.24

SECTION 2. That Chapter 26, Title 67, Idaho Code, be, and the same is25 hereby amended by the addition thereto of a NEW SECTION, to be known and des-26 ignated as Section 67-2617, Idaho Code, and to read as follows:27 67-2617. MIGRATION OF DIVISION OF OCCUPATIONAL AND PROFESSIONAL LI-28 CENSES RULES INTO STATUTE. No later than December 31, 2026, the division29 of occupational and professional licenses shall submit to the legislative30 services office proposed legislation that transfers all division of occu-31 pational and professional licenses administrative rule chapters less than32 eight (8) pages into statute.33

SECTION 3. An emergency existing therefor, which emergency is hereby34 declared to exist, this act shall be in full force and effect on and after35 July 1, 2026.36
