RS33468 / H0850 This legislation repeals §56-267 and §56-2205 of Idaho Code, Obamacare Expansion, the costs of which have been considerably more than originally projected. Additional changes are made to §31-3502 where the expansion is referenced.

The total savings from the total funding sources is $1.334 billion, all funds, using actual 2026 appropriations as follows: • General Fund: $91.7 million • Dedicated Hospital Assessment Fund: $25.1 million • Dedicated Cooperative Welfare Fund: $196.2 million • Cooperative Welfare Federal Fund: $1.031 billion • Total: $1.344 billion • Note: The FY27 budget request is close to the FY26 actual appropriation. It is important to note that those who move off Medicaid will be eligible for Advanced Premium Tax Credit policies if they choose to work.

LEGISLATURE OF THE STATE OF IDAHO Sixty-eighth Legislature Second Regular Session - 2026 IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 850 BY HEALTH AND WELFARE COMMITTEE AN ACT 1 RELATING TO MEDICAID; AMENDING SECTION 31-3502, IDAHO CODE, TO REMOVE A CODE 2 REFERENCE; REPEALING SECTION 56-267, IDAHO CODE, RELATING TO MEDICAID 3 ELIGIBILITY EXPANSION; REPEALING SECTION 56-2205, IDAHO CODE, RELATING 4 TO LEGISLATIVE APPROVAL AND MEDICAID EXPANSION LIMITS; AND PROVIDING AN 5 EFFECTIVE DATE. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 31-3502, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 31-3502. ELIGIBILITY FOR FINANCIAL ASSISTANCE. (1) Notwithstanding 10 any provision of law or rule to the contrary, no person eligible for medic- 11 aid pursuant to section 56-254 or 56-267, Idaho Code, shall be eligible for 12 financial assistance pursuant to this chapter as it existed on March 1, 2022. 13 (2) Notwithstanding any provision of law or rule to the contrary, no 14 person eligible for health insurance shall be eligible for financial assis- 15 tance pursuant to this chapter as it existed on March 1, 2022. 16 (3) Notwithstanding any provision of law or rule to the contrary, no 17 person in a commitment proceeding pursuant to chapter 3, title 66, Idaho 18 Code, who is eligible for medicaid or eligible for health insurance shall be 19 eligible for financial assistance pursuant to this chapter as it existed on 20 March 1, 2022. 21 (4) A board of county commissioners, the board of the catastrophic 22 health care cost program, or the department of health and welfare receiving 23 an application for assistance for services received through March 31, 2022, 24 shall process such application pursuant to this chapter as it existed on 25 March 1, 2022. 26 (5) It is the intent of the legislature that moneys saved by counties 27 pursuant to this section may be used for additional county aid to public 28 health districts as required by section 39-424A, Idaho Code. 29 SECTION 2. That Section 56-267, Idaho Code, be, and the same is hereby 30 repealed. 31 SECTION 3. That Section 56-2205, Idaho Code, be, and the same is hereby 32 repealed. 33 SECTION 4. This act shall be in full force and effect on and after Jan- 34 uary 1, 2028. 35 -- 1 of 1 --
