Adds to existing law to provide that bicyclists and mountain operators shall have certain liabilities and duties.

This bill establishes a new Chapter 33, in Title 6, to be titled the Responsibilities and Liabilities of Bicyclists and Mountain Operators. The new chapter would define certain terms, and outline duties for both mountain operators and bicyclists with respect to activity at Idaho mountain areas, as defined. This bill limits liability for mountain operators from actions against it by individuals undertaking the activity of bicycling on its property, recognizing that bicycling is an inherently dangerous sport and it is nearly impossible for mountain operators to eliminate risk. It also establishes responsibilities and affirmative acts for which mountain operators shall be liable, including posting signage and negligent actions.
