STATEMENT OF PURPOSE
The purpose of this legislation is to correct Idaho Code Section 34-1815 to reflect the ruling issued in Idaho Coalition United for Bears v. Cenarrusa, 234 F. Supp. 2d. 1159 (D. Idaho 2001) which invalidated the section as vague and unconstitutionally broad. This legislation prevents initiative and referendum sponsors and workers from intentionally misrepresenting the contents of petitions in order to gather signatures, with violations constituting a misdemeanor rather than the previous felony penalty. This legislation reflects similar laws found in other states.
